RETURN POLICY
We
stand behind the beauty and craftsmanship of the fine clothing we create however
should you be dissatisfied with your purchase we offer a full refund
within 30 days of the date your item was shipped. If for any reason you
want to return the item you purchased please contact us at 212-626-8350 and
request a Return Merchandise Authorization code, please be advised packages
without an authorization number are subject to refusal and returned to sender.
Return Merchandise Authorization codes cannot be requested or issued via
email. You have 30 calendar days from the date your purchase
was shipped to request this return code, after this time we can only offer
a store credit for returned items.
INSTRUCTIONS FOR RETURN

Please call us at 212-626-8350 to
request your Return Merchandise Authorization number, when calling specify your
name and which item was purchased. ONLY THE PERSON WHO MADE THE PURCHASE
CAN REQUEST THE RMA NUMBER. •
Package your return carefully. Please
use the manner in which we originally sent you the item as a guide to
repackaging your return. Do not use shipping envelopes of any kind
as they offer very little protection while in transit and any damage
that may occur during shipping will adversely affect your return.

Include all item sent with your purchase
such as clothing boxes and appraisals. Any items missing from your return are
subject to a replacement charge deducted from the total amount of your return.

Please do not write words like ”clothing”
anywhere on the package as this only invites theft. Also mark your package with
the return number in a conspicuous manner, packages without a visible return
number are subject to refusal. Remember to insure your package against loss
during delivery. We cannot be responsible for lost packages that were not
properly insured. Under no circumstances do we reimburse return
shipments, any return shipping is done so at the customer's expense.
TIPS FOR RETURNING YOUR ITEM
We suggest using the United States Post Office’s Priority Mail for return
shipping. It is mandatory that your return package be insured for the full
purchase price and we strongly recommend adding signature confirmation
service. Package your return safely, the Post Office offers shipping
materials at low or no cost. Include a note with the purchaser's name or a
printout of your order page to prevent any delays in processing your return.
Make sure your item is secure within the package to prevent damage during
shipping. DO NOT REUSE THE BOX WE SENT YOUR ITEM IN OR USE A SHIPPING
ENVELOPE OF ANY KIND! Used boxes and shipping envelopes
can be a reason an insurance claim is denied. It is very important to
record all tracking information, if an item is missing during the return
shipping it is the customer's responsibility to locate the package. If
an item is determined to be lost it is also the customer’s responsibility to
file an insurance claim with the shipping company, any money received from such
a claim will be considered a refund. Do not under insure your
return for this reason. Missing packages that were not properly insured
cannot be refunded, CHARLEY 5.0 cannot be held responsible if a return
shipment was not insured or if an insurance claim is denied by the shipper.
SECURITY TAG
A security tag is attached to all items shipped to prevent "wear and
return" sales. Any returned items with a damaged (obviously removed and
replaced) or missing tag will be subject to a 15% restocking fee deducted from
the amount being returned.
LATE RETURNS
Any items received after the 30 return period will be subject
to a store credit regardless if the customer contacts us for the RMA number
within the 30 days.
Refunds will be
issued as a credit back to the card used for the original purchase or in the
event we cannot return the funds in this manner a company check will be
drawn and mailed. Any checks issued will be drawn in the name of the customer
who made the purchase, we cannot issue checks to any third party for any reason.
Please allow 3 to 4 business days for the credit to appear on your statement.
RETURN
SHIPMENTS
Please call us in
advance for instructions before shipping your item. Due to new
insurance regulations we can no longer provide pre-printed return labels,
customers need to be aware that the insurance burden for any return shipments
falls on the legal owner of the item.

CHARLEY 5.0 is a full service clothing store and we offer a lifetime warranty
on all our creations ensuring your clothing stays beautiful for the life you own
it. We stand the quality and craftsmanship of the clothing we create. This offer applies to clothing purchased from the CHARLEY 5.0, Corp. website and is subject to change without advance notice to the
customer. clothing that shows visible signs of abuse is not subject to this
policy and can be repaired at a reduced fee. CHARLEY 5.0 does
not guarantee or offer to replace any center diamonds.
PAYMENTS
AND SHIPPING
We accept all
major credit cards (Visa, MasterCard, American Express and Discover) from CHECKOUT system on our site. Customers using the
CHECKOUT can select either the PayPal®
or Authorize.Net® systems for secure payment
processing. It is not necessary to have a
PayPal® account to purchase items with this method.
Transactions taken through the Authorize.Net® system
will appear on the customer's statement as CHARLEY 5.0. Payments made
through either the PayPal® or
Authorize.Net® systems before 6:00 PM EST
will be processed the same day, orders taken after this time will be processed
the following business day. Orders received on a Friday after 6:00 PM EST
or on Saturday and Sunday will be processed on the following
Monday. Please note that most of our items are made to your order, this
requires up to three business days to manufacture the item and prepare it for
shipping. Items that are in stock at the time your order is processed can be
shipped the same day otherwise it will be shipped the next day. For all orders
over $1,000 we offer free shipping within the United States, for orders under
$1,000 we offer standard shipping via FedEx™ 2nd Day
Air for $19.99 and FedEx™ Express
Saver (3 day) shipping for $9.99. Guaranteed Overnight
delivery through FedEx™ is $49.99 and can be requested when
placing the order, by selecting this service you are paying for Overnight
shipping from the day your item is ready to be shipped. The
preferred method of shipment is FedEx™and all
shipments will require a signature so please make the proper
arrangements to receive your package. A tracking number for your shipment
will be provided after the shipment is picked up by the carrier and will be sent
to the email address you provided with your order. CHARLEY 5.0
cannot ship packages to P.O. boxes.
TRACKING INFORMATION
A tracking
number will be provided when your order is shipped. When placing your order it
is important to provide us with a valid email address and a contact telephone
number so the tracking information can be provided to you automatically. If you
cannot provide us with this contact information you can feel free to call us for
your tracking number. For customers who return items a tracking
number is provided by request. Please call or email for a return shipment's
tracking number.
INTERNATIONAL SHIPPING
We can and do
ship worldwide for a flat fee of $75. Customers receiving packages outside of
the United States must pay for the shipping, orders received from international
addresses that did not pay the fee cannot be shipped until the fee has been
received. ALL INTERNATIONAL ORDERS MUST INCLUDE A CONTACT TELEPHONE
NUMBER FOR THE SHIPPING MANIFEST. Any customs fees are the
sole responsibility of the recipient, failure to pay the customs fee is not
a condition of return and the recipient will be liable for all return shipping
costs. We do our best to keep informed of any restrictions involved for shipping
finished clothing to your respective country. If an item cannot be shipped due to
a restriction the customer will be notified and the order will be refunded.
Under no circumstances can orders be received from or shipped to St.
Lucia, Singapore, Malaysia, Indonesia, Hong Kong and Thailand due
to a high incidence of fraud or to any African country due to a continent wide
restriction on finished clothing import. France does not allow
finished clothing import from the United States.
SPECIAL
ORDERS
CHARLEY 5.0 is a full service clothing manufacturer capable of making anything you
can imagine and we can do this for our customers as a "special order". A
SPECIAL ORDER IS DEFINED AS AN ITEM THAT DOES NOT APPEAR ON OUR WEBSITE OR AN
ITEM THAT HAS BEEN MODIFIED FROM ITS ORIGINAL FORM AT THE CUSTOMER'S
REQUEST. Special order items cannot be returned for a refund, we offer
to exchange this purchase for store credit. The customer will be made aware
that an order is not returnable under these terms prior to any transaction
and a written confirmation from the customer acknowledging these terms must be received before we can proceed with an order.
SALES TAX
Sales tax must be
applied to all products received within the state of New York. The current sales
tax rate is 8.875%. Items shipped outside of New York are not subject to sales
tax.
PRIVACY
POLICY
This website uses
temporary internet files also known as cookies to record each visitor to our
website. This allows us to track new and return users to the site as well as
diagnose potential problems with the website server. These
cookies also allow you to utilize the shopping cart feature, if your
computer is configured to not accept these cookies the shopping cart may not
work. These cookies are not malicious and are programmed to self delete in 30
days from the date of your last visit to this site. Your privacy is of great
concern to us. We do not sell personal information associated with any customer
to other organizations.
ORDER
CANCELLATION
We generally
process orders taken through the 'buy now' feature on this website on
the following business day the order was received, orders received
after 6:00 PM EST Friday and weekends will be processed the following
Monday barring any major holidays. We ask that if you intend on cancelling your
order that you contact us preferably by telephone within 48 hours of the time
the order was placed to effectively stop your order from being shipped. Orders
cancelled after 48 hours may be subject to a cancellation fee
depending on the status of the order. Orders cancelled after an item is
shipped are subject to charges associated with the cost of shipping
and will be deducted from the total amount being returned. M.A. clothing Designs,
Corp. reserves the right to cancel an order for any reason with all funds being
returned to the customer in the manner they were received.
TYPOGRAPHICAL ERRORS
CHARLEY 5.0 is not responsible for any errors of information on our website. We
reserve to the right to refuse or cancel an order if it is determined the price
listed was in error with any and all funds being returned in the manner they
were received. Items added to the site that have not yet been priced will
be marked as "$0.00". Orders received either over the phone for these items will be refused.
LIMITATION
OF LIABILITY
CHARLEY 5.0 shall not be liable for any special or consequential damages that
result from the use of, or the inability to use, the materials on this site.
Applicable law may not allow the limitation of exclusion of liability or
incidental or consequential damages, so the above limitation or exclusion may
not apply to you. Purchaser agrees that this Agreement will, for all intent and
purposes, be governed by and interpreted in accordance with the laws of New York
as applied to contracts entered into and to be performed entirely in the state
of New York, without regard to conflicts of law provisions. Purchaser agrees
that any dispute arising out of this Agreement may be addressed by binding
arbitration at CHARLEY 5.0’s sole discretion. Purchaser agrees
that in the absence of arbitration, any suit or proceeding arising out of or
relating to this Agreement shall be commenced exclusively in state court in New
York City, New York, and that Purchaser irrevocably submits to the exclusive
jurisdiction and venue of such courts. If allowed by law, all parties using the
site or purchasing products from CHARLEY 5.0 agree not to bring
any legal action on any legal theory against CHARLEY 5.0 more
than one year after the date of the applicable invoice except for actions
arising out of longer warranties offered by CHARLEY 5.0
